{"id":2496,"date":"2021-05-21T11:02:59","date_gmt":"2021-05-21T14:02:59","guid":{"rendered":"http:\/\/travelbyheart.gl\/the-fine-print\/"},"modified":"2026-06-30T16:10:46","modified_gmt":"2026-06-30T19:10:46","slug":"the-fine-print","status":"publish","type":"page","link":"https:\/\/travelbyheart.gl\/en\/the-fine-print\/","title":{"rendered":"Terms  and conditions of sale and delivery"},"content":{"rendered":"<p class=\"p1\"><b>TERMS AND CONDITIONS OF SALE AND DELIVERY<\/b><\/p>\n<p class=\"p2\"><b>Travel by Heart &#8211; Greenland ApS<\/b><\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>1. <\/b><\/span><b>INTRODUCTION<\/b><\/p>\n<p class=\"p2\">These terms and conditions govern the contractual relationship between Travel by Heart \u2013<\/p>\n<p class=\"p1\"><span class=\"s2\">Greenland ApS (hereinafter <\/span><b>\u2018TBH\u2019<\/b>) and the traveller (hereinafter <b>\u2018the customer\u2019<\/b>) who purchases a<\/p>\n<p class=\"p1\">package tour. The agreement is entered into and performed in accordance with the Package Travel Act<\/p>\n<p class=\"p1\">(Act No. 1666 of 26 December 2017 on package tours and linked travel arrangements).<\/p>\n<p class=\"p1\">We recommend that you read these terms and conditions. It is in our mutual interest that we have a clear<\/p>\n<p class=\"p1\">understanding of the trip and its contents. We expect that you, as a customer, have familiarised yourself<\/p>\n<p class=\"p1\">with the applicable travel terms and conditions and the contractual basis between you as a customer and<\/p>\n<p class=\"p1\">us as a travel provider.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p3\"><span class=\"s1\"><b>2. <\/b><\/span><b>DELAYS AND FORCE MAJEURE<\/b><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>a. <\/b><\/span><b>Travel by Hearts\u2019 response to delays<\/b><\/p>\n<p class=\"p2\">We have no control over the Arctic climate, which, regardless of the season, may cause delays<\/p>\n<p class=\"p2\">and changes to travel plans that are beyond TBH\u2019s control. TBH accepts no liability for any<\/p>\n<p class=\"p2\">delays and any resulting changes or cancellations to travel plans due to circumstances beyond<\/p>\n<p class=\"p2\">TBH\u2019s control. TBH will always work diligently to ensure the trip proceeds as planned.In the event of delays or changes to travel plans due to circumstances beyond TBH\u2019s control<\/p>\n<p class=\"p2\">(including weather conditions, airline decisions, government intervention, etc.), TBH will do<\/p>\n<p class=\"p2\">everything in its power to:<\/p>\n<p class=\"p2\"><span class=\"s4\">\u2022 <\/span>Assist the customer in obtaining refunds from hotels, activity providers and other<\/p>\n<p class=\"p2\">service providers<\/p>\n<p class=\"p4\"><span class=\"s4\">\u2022 <\/span>Help with rebooking cancelled or altered services<\/p>\n<p class=\"p2\"><span class=\"s4\">\u2022 <\/span>Coordinate with insurance companies and other parties to minimise the customer\u2019s<\/p>\n<p class=\"p2\">financial loss<\/p>\n<p class=\"p1\"><span class=\"s4\">\u2022 <\/span>Keep the customer informed of the status and alternative solutions<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>3. <\/b><\/span><b>Refund liability in the event of delays<\/b><\/p>\n<p class=\"p2\"><b>TBH will only refund the amounts that the company actually receives from suppliers<\/b><\/p>\n<p class=\"p2\">(hotels, airlines, activity providers, etc.).<\/p>\n<p class=\"p2\"><b>TBH\u2019s service fee is not refunded <\/b>in the event of delays or cancellations caused by<\/p>\n<p class=\"p2\">circumstances beyond the company\u2019s control.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>4. <\/b><\/span><b>Communication in the event of delays<\/b><\/p>\n<p class=\"p2\">TBH undertakes to inform the customer as soon as possible upon becoming aware of delays or<\/p>\n<p class=\"p2\">changes to the itinerary and will actively assist the customer with:<\/p>\n<p class=\"p1\"><span class=\"s4\">\u2022 <\/span>Contacting relevant suppliers<\/p>\n<p class=\"p4\"><span class=\"s4\">\u2022 <\/span>Gathering the necessary documentation for insurance claims<\/p>\n<p class=\"p4\"><span class=\"s4\">\u2022 <\/span>Coordinating alternative arrangements where possible<\/p>\n<p class=\"p1\"><span class=\"s4\">\u2022 <\/span>Advice on the customer\u2019s rights vis-\u00e0-vis suppliers<\/p>\n<p class=\"p1\">This assistance is provided as a service but does not entail any extended liability for TBH beyond that<\/p>\n<p class=\"p1\">required by law.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p5\"><span class=\"s1\"><b>5. <\/b><\/span><span class=\"s5\"><b>GENERAL <\/b><\/span><b>REFUND POLICY<\/b><\/p>\n<p class=\"p4\"><span class=\"s2\"><b>a. <\/b><\/span><b>Basic principle<\/b><\/p>\n<p class=\"p2\">TBH will only refund the amounts that the company actually receives as a refund from<\/p>\n<p class=\"p2\">suppliers (hotels, airlines, activity providers, insurance companies, etc.).<\/p>\n<p class=\"p2\"><span class=\"s6\">2<\/span><span class=\"s2\"><b>b. <\/b><\/span><b>Service fee<\/b><\/p>\n<p class=\"p1\">TBH\u2019s service fee is not refunded in the event of:<\/p>\n<p class=\"p1\"><span class=\"s4\">\u2022 <\/span>Delays or cancellations caused by circumstances beyond the company\u2019s control<\/p>\n<p class=\"p4\"><span class=\"s4\">\u2022 <\/span>The customer\u2019s own cancellation (unless covered by cancellation insurance due to illness)<\/p>\n<p class=\"p4\"><span class=\"s4\">\u2022 <\/span>Changes to travel plans at the customer\u2019s request<\/p>\n<p class=\"p2\"><span class=\"s2\"><b>c. <\/b><\/span><b>Documentation<\/b><\/p>\n<p class=\"p2\">The customer must, upon request, provide documentation of any refunds received directly<\/p>\n<p class=\"p2\">from suppliers or insurance companies.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>6. <\/b><\/span><b>TRAVEL DOCUMENTS<\/b><\/p>\n<p class=\"p2\">Upon conclusion of the agreement, TBH shall, without undue delay, send the travel documents<\/p>\n<p class=\"p2\">(e.g. a travel voucher, an order confirmation, an invoice and\/or an itinerary) to the customer.<\/p>\n<p class=\"p4\">The sending of travel documents and other correspondence between the customer and TBH,<\/p>\n<p class=\"p4\">including but not limited to changes to the package tour, shall take place via the email address or<\/p>\n<p class=\"p4\">other contact details provided by the customer when the agreement was concluded. The customer is<\/p>\n<p class=\"p4\">also obliged to provide the contact details necessary for TBH to contact the customer both before<\/p>\n<p class=\"p4\">and during the trip.<\/p>\n<p class=\"p2\">If the customer does not receive the travel documents within 72 hours, the customer must<\/p>\n<p class=\"p2\">contact TBH immediately. If the customer has provided an email address, they should first<\/p>\n<p class=\"p2\">check their spam filter.<\/p>\n<p class=\"p2\">The customer is obliged, upon receipt, to review the travel documents and \u201cpractical<\/p>\n<p class=\"p2\">information\u201d sent and to react immediately to TBH if the information does not correspond to<\/p>\n<p class=\"p2\">what was agreed.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>7. <\/b><\/span><b>INSURANCE<\/b><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>a. <\/b><\/span><b>Insurance information<\/b><\/p>\n<p class=\"p4\">Prior to the conclusion of the agreement, TBH shall provide the customer with information<\/p>\n<p class=\"p4\">regarding the option or obligation to take out insurance covering the customer\u2019s expenses in the<\/p>\n<p class=\"p4\">event of termination of the agreement (cancellation insurance)<\/p>\n<p class=\"p4\"><span class=\"s6\">3<\/span>) or the costs of repatriation etc. in the event of accident, illness or death (travel insurance), as well<\/p>\n<p class=\"p4\">as the terms and conditions of these insurance policies.<\/p>\n<p class=\"p2\"><b>We strongly recommend that the customer takes out comprehensive travel insurance<\/b><\/p>\n<p class=\"p2\"><b>with delay cover<\/b>. Please note that TBH\u2019s service fee is not covered by standard insurance<\/p>\n<p class=\"p2\">policies.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p2\"><span class=\"s1\"><b>8. <\/b><\/span><b>Illness cancellation insurance<\/b><\/p>\n<p class=\"p4\">We recommend that you take out cancellation insurance due to illness when you book your trip.<\/p>\n<p class=\"p4\">This must be taken out at the time of booking and must be paid for together with the deposit. If you<\/p>\n<p class=\"p4\">have taken out travel cancellation insurance when booking your trip, this means that you can cancel<\/p>\n<p class=\"p4\">the trip due to illness up until departure and receive a refund of the amount paid, with no<\/p>\n<p class=\"p4\">deductions other than the premium for the travel cancellation insurance itself. Travel cancellation<\/p>\n<p class=\"p4\">insurance costs 6.25% of the trip\u2019s price.<\/p>\n<p class=\"p4\">TBH receives commission on the sale of insurance policies. The customer may contact TBH to find<\/p>\n<p class=\"p4\">out the amount of the commission. If the customer wishes to take out cancellation insurance or<\/p>\n<p class=\"p4\">travel insurance via TBH, the customer must notify TBH of this before the agreement is finally<\/p>\n<p class=\"p4\">concluded.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p6\"><span class=\"s1\"><b>9. <\/b><\/span><b>PASSPORTS, VISAS AND TRAVEL DOCUMENTS<\/b><\/p>\n<p class=\"p4\">Upon conclusion of the agreement, TBH shall inform the customer of passport and visa<\/p>\n<p class=\"p4\">requirements, including information on the expected processing time for obtaining a visa. TBH<\/p>\n<p class=\"p4\">shall also provide information on any health-related formalities arising from vaccination<\/p>\n<p class=\"p4\">requirements or similar, as well as other documents and conditions necessary for the trip to take<\/p>\n<p class=\"p4\">place.<\/p>\n<p class=\"p2\">TBH\u2019s information to the customer regarding passport and visa requirements is based on the<\/p>\n<p class=\"p2\">rules applicable to Danish citizens. If the customer does not hold a Danish passport or holds<\/p>\n<p class=\"p2\">dual nationality, the customer must inform TBH of this.<\/p>\n<p class=\"p4\"><span class=\"s2\"><b>a. <\/b><\/span><b>Special rules for Greenland<\/b><\/p>\n<p class=\"p2\">Danish citizens do not require a visa for Greenland, Iceland and the Faroe Islands. Please note<\/p>\n<p class=\"p2\">that different rules may apply if you are resident in Denmark but are not a Danish citizen.<\/p>\n<p class=\"p4\"><span class=\"s6\">4<\/span>Greenland is not a member of the Schengen Area, but is only covered by the Schengen Information<\/p>\n<p class=\"p4\">System. This means that a Schengen visa does not grant access to Greenland. Applicants from<\/p>\n<p class=\"p4\">countries subject to visa requirements must state when applying for a Danish visa that the visa is<\/p>\n<p class=\"p4\">also to be valid for Greenland.<\/p>\n<p class=\"p4\">EU citizens\u2019 national ID cards cannot be used as proof of identity when entering Greenland. They<\/p>\n<p class=\"p4\">must bring a passport.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p6\"><span class=\"s1\"><b>10. <\/b><\/span><b>THE CUSTOMER\u2019S OBLIGATIONS<\/b><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>a. <\/b><\/span><b>Correct name details<\/b><\/p>\n<p class=\"p2\">The customer is responsible for ensuring that the names appearing on their travel documents<\/p>\n<p class=\"p2\">and bookings are identical to the full name appearing on the customer\u2019s passport. If the<\/p>\n<p class=\"p2\">customer becomes aware of any discrepancies between travel documents and their passport,<\/p>\n<p class=\"p2\">they must notify TBH immediately.<\/p>\n<p class=\"p1\"><span class=\"s2\"><b>b.<\/b><\/span><b>Punctuality<\/b><\/p>\n<p class=\"p2\">The customer must have completed any check-in in accordance with the times and locations<\/p>\n<p class=\"p2\">for the latest check-in on the outward and return journeys as stated in the itinerary or by other<\/p>\n<p class=\"p2\">clear instructions.<\/p>\n<p class=\"p2\">If flight tickets form part of the package holiday, these must be used in the correct order. If the<\/p>\n<p class=\"p2\">customer does not use the flight tickets in the correct order, the airline will cancel the<\/p>\n<p class=\"p2\">remaining flight segments. The customer may therefore not use individual segments of a flight<\/p>\n<p class=\"p2\">itinerary.<\/p>\n<p class=\"p2\"><span class=\"s2\"><b>c. <\/b><\/span><b>Rules of conduct<\/b><\/p>\n<p class=\"p4\">In the event of expulsion, the customer is responsible for their own return transport and any<\/p>\n<p class=\"p4\">resulting expenses. In the event of expulsion, the customer is not entitled to receive any form of<\/p>\n<p class=\"p4\">refund of the package tour price. TBH is not liable to public authorities.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p6\"><span class=\"s1\"><b>11. <\/b><\/span><b>CHANGES TO THE PACKAGE TOUR<\/b><\/p>\n<p class=\"p4\"><span class=\"s2\"><b>a. <\/b><\/span><b>Minor changes<\/b><\/p>\n<p class=\"p2\">Prior to the commencement of the package tour, TBH is entitled to make minor changes to the<\/p>\n<p class=\"p2\">package tour without the customer\u2019s consent and without liability. The customer is obliged to<\/p>\n<p class=\"p2\">accept such changes.<\/p>\n<p class=\"p4\"><span class=\"s6\">5<\/span><span class=\"s2\"><b>b. <\/b><\/span><b>Significant changes<\/b><\/p>\n<p class=\"p4\">If, prior to the commencement of the package tour, TBH either makes significant changes to the<\/p>\n<p class=\"p4\">package tour, or is unable to provide specific services which the customer has requested and which<\/p>\n<p class=\"p4\">TBH has agreed to provide, or increases the price of the tour by more than 8%, the customer has<\/p>\n<p class=\"p4\">the following rights: the customer may cancel the contract and receive a refund of the amounts paid<\/p>\n<p class=\"p4\">in respect of the trip.<\/p>\n<p class=\"p2\"><span class=\"s2\"><b>c. <\/b><\/span><b>Price changes<\/b><\/p>\n<p class=\"p1\">TBH may, after the conclusion of the contract, make changes to the agreed price of the package tour if<\/p>\n<p class=\"p1\">there are changes in: the price of passenger transport as a result of costs relating to fuel or other energy<\/p>\n<p class=\"p1\">sources; taxes, duties or charges for the travel services included in the package tour imposed by a third<\/p>\n<p class=\"p1\">party.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>12. <\/b><\/span><b>CANCELLATION<\/b><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>a. <\/b><\/span><b>Cancellation fees<\/b><\/p>\n<p class=\"p2\">In the event of cancellation no later than 60 days before the departure date, TBH will refund the<\/p>\n<p class=\"p2\">customer the amount paid, less the deposit paid and a fee of <b>DKK 2,500.00 per person<\/b>. <b>Please<\/b><\/p>\n<p class=\"p2\"><b>note<\/b>: for tailor-made trips<b>,<\/b> the fee\/deposit corresponds to 50% of the trip price.<\/p>\n<p class=\"p4\">If cancellation occurs later than 60 days before the departure date and no later than 30 days before<\/p>\n<p class=\"p4\">the departure time stated in the travel documents, <b>TBH is entitled to charge 50% of the total<\/b><\/p>\n<p class=\"p4\"><b>price of the trip<\/b>.<\/p>\n<p class=\"p2\">If cancellation occurs later than 30 days before departure, <b>TBH is entitled to charge the total<\/b><\/p>\n<p class=\"p2\"><b>price of the trip as a cancellation fee.<\/b><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>b. <\/b><\/span><b>Cancellation due to exceptional circumstances<\/b><\/p>\n<p class=\"p1\">The customer may cancel a package tour without paying a fee before the start of the package tour if<\/p>\n<p class=\"p1\">unavoidable and extraordinary circumstances arise at the destination or in its immediate vicinity which<\/p>\n<p class=\"p1\">significantly affect the provision of the package tour or the transport of passengers to the destination.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p3\"><span class=\"s1\"><b>13. <\/b><\/span><b>COMPLAINTS AND DEFECTS<\/b><\/p>\n<p class=\"p2\"><span class=\"s6\">6<\/span>If a defect is discovered after the start of the trip \u2013 en route or at the destination \u2013 the customer<\/p>\n<p class=\"p2\">must, immediately upon discovery, complain about the defect to TBH, its representative at the<\/p>\n<p class=\"p2\">destination or to the subcontractor to whom the defect relates. If TBH\u2019s representative or<\/p>\n<p class=\"p2\">subcontractor is unable or unwilling to remedy the defect, or if, in the customer\u2019s opinion, the<\/p>\n<p class=\"p2\">defect is not remedied satisfactorily, the customer must lodge a complaint directly with the<\/p>\n<p class=\"p2\">organiser.<\/p>\n<p class=\"p2\">The customer must ensure that the complaint is recorded by TBH\u2019s staff and\/or subcontractors<\/p>\n<p class=\"p2\">on site \u2013 e.g. by means of a note in a hotel register or in another written form. In addition, the<\/p>\n<p class=\"p2\">customer should ensure that they are given a receipt for the complaint.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>14. <\/b><\/span><b>LIABILITY FOR DAMAGES<\/b><\/p>\n<p class=\"p4\"><span class=\"s2\"><b>a. <\/b><\/span><b>Set-off<\/b><\/p>\n<p class=\"p2\">When submitting their complaint to TBH, the customer must state whether they have also<\/p>\n<p class=\"p2\">sought compensation from the carrier on the basis of EU regulations on passenger rights and<\/p>\n<p class=\"p2\">liability in passenger transport. If the customer has received compensation and\/or<\/p>\n<p class=\"p2\">reimbursement from the carrier, TBH is entitled to set off such compensation.<\/p>\n<p class=\"p2\"><span class=\"s2\"><b>b. <\/b><\/span><b>Limitations of liability<\/b><\/p>\n<p class=\"p2\">Liability is limited in accordance with international conventions and EU regulations as<\/p>\n<p class=\"p2\">described in the detailed provisions.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>15. <\/b><\/span><b>TRAVEL GUARANTEE FUND<\/b><\/p>\n<p class=\"p2\">At Travel by Heart &#8211; Greenland, your peace of mind is our priority. We are registered with the<\/p>\n<p class=\"p2\">Travel Guarantee Fund, which means you are financially protected if you are travelling from<\/p>\n<p class=\"p2\">Denmark and if we or one of our partners were to go bankrupt. Your package holiday is<\/p>\n<p class=\"p2\">covered, so you will get your money back if the trip is cancelled due to bankruptcy. If you<\/p>\n<p class=\"p2\">have already set off, the fund will ensure your return transport at no extra cost.
