{"id":2496,"date":"2021-05-21T11:02:59","date_gmt":"2021-05-21T14:02:59","guid":{"rendered":"http:\/\/travelbyheart.gl\/the-fine-print\/"},"modified":"2025-09-18T04:08:42","modified_gmt":"2025-09-18T07:08:42","slug":"the-fine-print","status":"publish","type":"page","link":"https:\/\/travelbyheart.gl\/en\/the-fine-print\/","title":{"rendered":"The fine print"},"content":{"rendered":"<h3 class=\"p1\" style=\"text-align: left;\">TERMS OF SALE AND DELIVERY<\/h3>\n<h3 class=\"p1\" style=\"text-align: left;\">Travel by Heart &#8211; Greenland ApS<\/h3>\n<h3 style=\"text-align: left;\"><\/h3>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">1.<b> <\/b>INTRODUCTION<\/p>\n<p class=\"p1\" style=\"text-align: left;\">These terms and conditions govern the contractual relationship between Travel by Heart &#8211; Greenland ApS (hereinafter<\/p>\n<p class=\"p1\" style=\"text-align: left;\">hereinafter &#8216;TBH&#8217;) and the traveler (hereinafter &#8216;Customer&#8217;) who purchases a package tour. The contract is concluded <\/p>\n<p class=\"p1\" style=\"text-align: left;\">and implemented in accordance with the Package Travel Act (Act no. 1666 of 26\/12\/2017 on<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Packages and bundled travel arrangements).<\/p>\n<p class=\"p1\" style=\"text-align: left;\">We recommend that you read these terms and conditions. It is common best that we have perception of the journey and<\/p>\n<p class=\"p1\" style=\"text-align: left;\">its content. We expect you as a customer to have familiarized yourself with the applicable travel conditions, <\/p>\n<p class=\"p1\" style=\"text-align: left;\">and the contractual basis between you as a customer and us as a travel provider.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">2.<b> <\/b>DELAYS AND FORCE MAJEURE<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Travel by Heart&#8217;s response to delays<\/p>\n<p class=\"p1\" style=\"text-align: left;\">We are not in control of the Arctic climate which, regardless of the season, can cause delays and changes.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">travel plans that are beyond TBH&#8217;s control. TBH disclaims any liability for any. <\/p>\n<p class=\"p1\" style=\"text-align: left;\">delays and resulting possible changes or cancellations of travel plans for conditions<\/p>\n<p class=\"p1\" style=\"text-align: left;\">which TBH has no influence on. TBH will always work diligently to ensure that the trip is completed as <\/p>\n<p class=\"p1\" style=\"text-align: left;\">In the event of delays or changes to travel plans due to circumstances beyond TBH&#8217;s control<\/p>\n<p class=\"p1\" style=\"text-align: left;\">(including weather conditions, airline dispositions, regulatory interventions, etc.), TBH will make<\/p>\n<p class=\"p1\" style=\"text-align: left;\">everything in the company&#8217;s power to:<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Assist<\/span> the customer in obtaining reimbursement from hotels, activity providers and other living<\/p>\n<p class=\"p1\" style=\"text-align: left;\">peripheral ears<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Help<\/span> with rebooking canceled or changed services<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Coordinate<\/span> with insurance companies and other parties to minimize the customer&#8217;s environmental impact<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Nominal losses<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Continuously<\/span> inform the customer about status and alternative solutions<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">3.<b> <\/b>REFUND LIABILITY IN CASE OF DELAYS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH will only refund the amounts that the company is actually reimbursed by the supplier.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">(hotels, airlines, activity providers, etc.).<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH&#8217;s service fee is not refundable in the event of delays or cancellations due to circumstances<\/p>\n<p class=\"p1\" style=\"text-align: left;\">teams outside the control of the company.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">4.<b> <\/b>COMMUNICATION IN CASE OF DELAYS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH undertakes to inform the customer as soon as possible upon knowledge of delays or<\/p>\n<p class=\"p1\" style=\"text-align: left;\">changes to the itinerary and will actively assist the customer with:<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Contact<\/span> relevant suppliers<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Collect<\/span> necessary documentation for insurance claims<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Coordination<\/span> of alternative events where possible<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Advice<\/span> on the customer&#8217;s rights against suppliers<\/p>\n<p class=\"p1\" style=\"text-align: left;\">This assistance is provided as a service but does not entail extended liability for TBH beyond the<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Statutory.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">5.<b> <\/b>GENERAL REFUND POLICY<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Basic principle<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH will only reimburse the amounts that the company actually receives reimbursed from the supplier.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">(hotels, airlines, activity providers, insurance companies, etc.).<\/p>\n<p class=\"p1\" style=\"text-align: left;\"><span class=\"s4\">2b<\/span>.<b> <\/b>Service fee<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH&#8217;s service fee is not refundable in case of:<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Delays<\/span> or cancellations caused by circumstances beyond the company&#8217;s control<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Customer&#8217;s<\/span> own cancellation (unless sickness cancellation insurance covers)<\/p>\n<p class=\"p1\" style=\"text-align: left;\">&#8211; <span class=\"s2\">Changes to<\/span> travel plans at the customer&#8217;s request<\/p>\n<p class=\"p1\" style=\"text-align: left;\">c.<b> <\/b>Documentation<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Upon request, Customer shall provide documentation for any refunds received<\/p>\n<p class=\"p1\" style=\"text-align: left;\">directly from suppliers or insurance companies.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">6.<b> <\/b>TRAVEL DOCUMENTS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH will forward the travel documents (e.g., travel documents, etc.) without undue delay after the conclusion of the agreement.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">For example, a travel voucher, order confirmation, invoice and\/or itinerary) to the customer.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Forwarding of travel documents and other correspondence between the customer and TBH, including<\/p>\n<p class=\"p1\" style=\"text-align: left;\">including but not limited to changes in the travel package, is made by e-mail or other<\/p>\n<p class=\"p1\" style=\"text-align: left;\">form of contact used by the customer in connection with the conclusion of the agreement. The customer is therefore <\/p>\n<p class=\"p1\" style=\"text-align: left;\">obliged to provide the contact information necessary for TBH to contact the customer.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">the customer both before and during the journey.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If the customer does not receive the travel documents within 72 hours, the customer must immediately contact<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH. If the customer has provided an email address, you should check the spam filter beforehand. <\/p>\n<p class=\"p1\" style=\"text-align: left;\">Upon receipt, the customer is obligated to review the submitted travel documents and &#8220;prac-<\/p>\n<p class=\"p1\" style=\"text-align: left;\">information&#8221; and immediately respond to TBH if the information is not in accordance with the<\/p>\n<p class=\"p1\" style=\"text-align: left;\">accordance with what has been agreed.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">7.<b> <\/b>ASSURANCES<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Insurance information<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH shall inform the customer prior to the conclusion of the contract about the possibility or obligation to<\/p>\n<p class=\"p1\" style=\"text-align: left;\">to take out insurance to cover the customer&#8217;s expenses in the event of termination of the contract (cancellation insurance).<\/p>\n<p class=\"p1\" style=\"text-align: left;\"><span class=\"s4\">3insurance<\/span>) or the cost of repatriation etc. in the event of accident, illness or death (travel insurance).<\/p>\n<p class=\"p1\" style=\"text-align: left;\">insurance) and the terms and conditions of these insurances.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">We strongly recommend that the customer takes out comprehensive travel insurance with delay<\/p>\n<p class=\"p1\" style=\"text-align: left;\">coverage. Please note that TBH service fees are not covered by standard insurance policies. <\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">8.<b> <\/b>SICKNESS CANCELLATION INSURANCE<\/p>\n<p class=\"p1\" style=\"text-align: left;\">We recommend that you take out a health cancellation insurance when you book your trip. This<\/p>\n<p class=\"p1\" style=\"text-align: left;\">must be taken out when booking the trip and must be paid together with the deposit. If the <\/p>\n<p class=\"p1\" style=\"text-align: left;\">when booking the trip, you have purchased a medical cancellation insurance, this means that you<\/p>\n<p class=\"p1\" style=\"text-align: left;\">until departure can cancel the trip due to illness and get the paid amount refunded<\/p>\n<p class=\"p1\" style=\"text-align: left;\">without any deductions other than the premium for the sickness cancellation insurance. A sickness cancellation <\/p>\n<p class=\"p1\" style=\"text-align: left;\">travel insurance costs 6.25% of the trip price.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH receives commission for the sale of insurance policies. By contacting TBH, the customer can obtain information <\/p>\n<p class=\"p1\" style=\"text-align: left;\">the amount of the commission. If the customer wishes to take out cancellation insurance or travel <\/p>\n<p class=\"p1\" style=\"text-align: left;\">insurance via TBH, the customer must inform TBH of this before the agreement is finalized.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">9.<b> <\/b>PASSPORTS, VISAS AND TRAVEL DOCUMENTS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH informs the customer about passport and visa requirements upon conclusion of the agreement, including information about<\/p>\n<p class=\"p1\" style=\"text-align: left;\">the expected acquisition time to obtain a visa. TBH also provides information about any <\/p>\n<p class=\"p1\" style=\"text-align: left;\">health formalities by virtue of vaccination requirements or similar as well as other docu-<\/p>\n<p class=\"p1\" style=\"text-align: left;\">and conditions that are necessary for the completion of the trip.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH&#8217;s information about passport and visa requirements for the customer is based on the rules for Danish<\/p>\n<p class=\"p1\" style=\"text-align: left;\">citizens. If the customer does not have a Danish passport or has dual citizenship, only <\/p>\n<p class=\"p1\" style=\"text-align: left;\">It will bring this to TBH&#8217;s attention.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>SPECIAL RULES FOR GREENLAND<\/p>\n<p class=\"p1\" style=\"text-align: left;\">For Danish citizens, there is no visa requirement for Greenland, Iceland and the Faroe Islands. Be up-<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Please note that different rules may apply if you are resident in Denmark but not Danish<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Citizen.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Greenland is not a member of Schengen, but only covered by the Schengen Information System.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">This means that the Schengen visa does not give access to Greenland. Persons from visa-required countries<\/p>\n<p class=\"p1\" style=\"text-align: left;\">When applying for a Danish visa, countries must state that the visa must also apply to Greenland.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">EU citizens&#8217; national ID cards cannot be used as an identification document when entering<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Greenland. They must bring passports.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">10.<b> <\/b>CUSTOMER OBLIGATIONS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Correct name information<\/p>\n<p class=\"p1\" style=\"text-align: left;\">The Customer is responsible for ensuring that the names appearing on their travel documents and bookings are<\/p>\n<p class=\"p1\" style=\"text-align: left;\">identical to the full name that appears on the customer&#8217;s passport. If the customer becomes aware of <\/p>\n<p class=\"p1\" style=\"text-align: left;\">discrepancies between travel documents and passports, the customer must immediately notify this to<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">b.<b> <\/b>Timely attendance<\/p>\n<p class=\"p1\" style=\"text-align: left;\">The customer must have completed any check-in in accordance with the information in the itinerary.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">or other clear indication of the time and place of the last check-in on the outbound and inbound flights.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">The return journey.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If airline tickets are part of the package tour, these must be used in the correct order.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If the customer does not use the flight tickets in the correct order, the airline will charge<\/p>\n<p class=\"p1\" style=\"text-align: left;\">zero out the remaining flight legs. The customer can therefore not only use individual routes. <\/p>\n<p class=\"p1\" style=\"text-align: left;\">of a flight.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">c.<b> <\/b>Rules of order<\/p>\n<p class=\"p1\" style=\"text-align: left;\">In the event of expulsion, the customer is responsible for their own repatriation and expenses resulting from<\/p>\n<p class=\"p1\" style=\"text-align: left;\">hereof. In the event of expulsion, the Customer shall not be entitled to receive any form of refund. <\/p>\n<p class=\"p1\" style=\"text-align: left;\">payment of the package price. TBH is not liable for the exercise of public authority. <\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">11.<b> <\/b>CHANGES IN THE TRAVEL PACKAGE<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Insignificant changes<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH is entitled, prior to the commencement of the package tour, to make minor changes without liability<\/p>\n<p class=\"p1\" style=\"text-align: left;\">changes to the travel package without the Customer&#8217;s consent. The customer is obliged to accept such changes. <\/p>\n<p class=\"p1\" style=\"text-align: left;\">no changes.<\/p>\n<p class=\"p1\" style=\"text-align: left;\"><span class=\"s4\">5b<\/span>.<b> <\/b>Significant changes<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If TBH, prior to the commencement of the package tour, either makes significant changes to the package tour<\/p>\n<p class=\"p1\" style=\"text-align: left;\">or cannot provide certain services requested by the customer and accepted by TBH.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">fails to deliver, or raises the price of the trip by more than 8%, the customer has the following rights<\/p>\n<p class=\"p1\" style=\"text-align: left;\">There: the customer can cancel the agreement and get a refund of the amounts paid for the trip.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">c.<b> <\/b>Price changes<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH may make changes to the agreed price for the package tour after the agreement has been concluded if<\/p>\n<p class=\"p1\" style=\"text-align: left;\">there are changes in: the price of carrying passengers due to fuel costs<\/p>\n<p class=\"p1\" style=\"text-align: left;\">or other energy sources, taxes, duties or fees for the package travel services that are<\/p>\n<p class=\"p1\" style=\"text-align: left;\">imposed by a third party.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">12.<b> <\/b>CANCELLATION<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Cancellation fees<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If canceled no later than 60 days prior to the departure date, TBH will refund the customer the amount paid<\/p>\n<p class=\"p1\" style=\"text-align: left;\">with deduction of the paid deposit, a fee of DKK 2,500.00 per person. Please note: in case of <\/p>\n<p class=\"p1\" style=\"text-align: left;\">tailor-made trips, the fee\/deposit corresponds to 50% of the trip price.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If canceled later than 60 days before the departure date and no later than 30 days before the date stated in the travel docu-<\/p>\n<p class=\"p1\" style=\"text-align: left;\">TBH is entitled to charge 50% of the total cost of the trip for the departure time stated in the<\/p>\n<p class=\"p1\" style=\"text-align: left;\">taken.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If cancellation occurs later than 30 days prior to departure, TBH is entitled to charge the total<\/p>\n<p class=\"p1\" style=\"text-align: left;\">price of the trip as a cancellation fee.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">b.<b> <\/b>Cancellation due to extraordinary circumstances<\/p>\n<p class=\"p1\" style=\"text-align: left;\">The Customer may cancel a package tour before the start of the package tour without paying a fee if<\/p>\n<p class=\"p1\" style=\"text-align: left;\">unavoidable and extraordinary events occur at the travel destination or in its immediate vicinity<\/p>\n<p class=\"p1\" style=\"text-align: left;\">ordinary circumstances that materially affect the provision of the package tour or transportation.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">of passengers to the destination.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">13.<b> <\/b>COMPLAINTS AND DEFECTS<\/p>\n<p class=\"p1\" style=\"text-align: left;\">If a defect is discovered after the start of the trip &#8211; en route or at the destination &#8211; the customer must<\/p>\n<p class=\"p1\" style=\"text-align: left;\">complain about the defect immediately upon discovery to TBH, its representative on the travel<\/p>\n<p class=\"p1\" style=\"text-align: left;\">the target or to the subcontractor to which the defect relates. If TBH&#8217;s representative or subcontractor <\/p>\n<p class=\"p1\" style=\"text-align: left;\">the supplier cannot or will not remedy or does not, in the customer&#8217;s opinion, remedy satisfactorily<\/p>\n<p class=\"p1\" style=\"text-align: left;\">the customer must complain directly to the organizer.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">The customer must ensure that the complaint is noted by TBH&#8217;s employees and\/or subcontractors.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">suppliers on site &#8211; for example, through a note in a hotel book or other written form. Here&#8230; <\/p>\n<p class=\"p1\" style=\"text-align: left;\">In addition, the customer should make sure to get a receipt for the complaint.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">14.<b> <\/b>LIABILITY<\/p>\n<p class=\"p1\" style=\"text-align: left;\">a.<b> <\/b>Offsetting<\/p>\n<p class=\"p1\" style=\"text-align: left;\">When submitting its complaint to TBH, the customer must state whether the customer has also applied for<\/p>\n<p class=\"p1\" style=\"text-align: left;\">damages or compensation from the carrier on the basis of EU regulations on passport<\/p>\n<p class=\"p1\" style=\"text-align: left;\">rights of action and liability for damages in passenger transportation. If the customer has received <\/p>\n<p class=\"p1\" style=\"text-align: left;\">compensation and\/or compensation from the carrier, TBH shall be entitled to set off compensation.<\/p>\n<p class=\"p1\" style=\"text-align: left;\">b.<b> <\/b>Limitations of liability<\/p>\n<p class=\"p1\" style=\"text-align: left;\">Liability is limited according to international conventions and EU regulations<\/p>\n<p class=\"p1\" style=\"text-align: left;\">as described in the detailed provisions.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\" style=\"text-align: left;\">15.<b> <\/b>TRAVEL GUARANTEE FUND<\/p>\n<p class=\"p1\" style=\"text-align: left;\">At Travel by Heart &#8211; Greenland, your safety is our priority. We are registered with Rejsega- <\/p>\n<p class=\"p1\" style=\"text-align: left;\">rantifonden, which means that you are financially secured if you are traveling out of Denmark, and<\/p>\n<p class=\"p1\" style=\"text-align: left;\">if we or one of our partners should go bankrupt. Your travel package is covered so that <\/p>\n<p class=\"p1\" style=\"text-align: left;\">You get your money back if your trip is canceled due to bankruptcy. If you&#8217;re already traveling, you&#8217;ll ensure <\/p>\n<p class=\"p1\" style=\"text-align: left;\">fund your repatriation at no extra cost.
